1. The Contract for a short-term holiday rental will be between Fort Spinney Holiday Bungalows (referred to as “us” or “we”) and the person making the booking and all members of the holiday party (referred to as “you” or “your”) in the following booking conditions. The Contract will be governed by UK law. The contract of hire is not effective until we have processed the deposit and issued written confirmation of the booking. The contract will be subject to these booking conditions, and must be complied with. Notice can be served for breach of this agreement, and may be given during the Holiday Period by delivery into the property and shall be deemed to have been received upon the expiration of 24 hours after service. The party leader must be 18 years of age at the time of booking.
Bookings will be confirmed by written or emailed confirmation on receipt of a website transaction, booking form / email received and a 25% deposit of the total cost of booking. The balance of the rental will be due for payment 4 weeks prior to the holiday commencement date and we reserve the right to cancel a holiday where payment has not been received at this time. If the booking is made within 4 weeks of the holiday start date the full rental will be required. Once confirmation of booking has been issued by us, you are responsible for the full rental. All prices are inclusive of VAT. Minimum booking is 3 nights.
There is a refundable breakages and damages security deposit of £100 payable at the time of the booking. This will be automatically refunded to your bank account within 14 days of your departure should there be no damage to the property or furnishings. There is a charge of £25 for a dog staying in the ‘dog-friendly’ property.
Cancellations must be immediately notified to us by phone and confirmed by email or in writing. The booking deposit is non-refundable under any circumstances. Any cancellations by you within 60 days (8 weeks) of your arrival day will not receive any refund. Please note that by confirming a booking you are entering into a contractual agreement and are liable for the full cost of the holiday. We strongly recommend that you take out cancellation insurance this is available at a low cost from most insurance brokers, to cover yourself in this eventuality. Cancellation Insurance is not compulsory but we strongly recommend such insurance to protect against losing monies paid for the holiday.
Except as set out in this paragraph, we shall not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under our contract with you that is caused by events outside our reasonable control (such as serious damage to the venue, serious adverse weather conditions, a pandemic or epidemic, or interruption or failure of utility services such as electric power, gas or water). In these circumstances, we shall use every effort to notify you as soon as is reasonably practical and to move the dates of your stay by agreement with you. If, as a result of such events, we believe we have no alternative but to cancel your booking, we shall use reasonable endeavours to help you find an alternative property of a similar standard for a similar price but our sole liability to you shall be to refund you any money you have paid towards your stay. Should national or regional restrictions or lockdown be in place due to COVID-19 leading into either party being able to uphold the booking, we will offer you a full refund or move your booking to an alternative date. If you contract Covid-19, and you have proof pertaining to yourself that you are unable to travel by government law / instructions then we will look to refund you or move tour booking to an alternative date. By booking with us you are stating that you agree that you will not travel to Fort Spinney should any of the party display symptoms relating to COVID-19 or other infectious diseases.
Please do not arrive before 4pm on the commencement date, and please vacate your bungalow by 9am on the day of departure, after placing all linen and towels in the shower and opening windows to ventilate the property.
Under no circumstances may more than four people occupy the 2 bedroom bungalows and no more than 6 in the 3 bedroom bungalows- this includes children of ALL ages. We reserve the right to refuse admittance if this condition is not observed.
The use of the accommodation at Fort Spinney Holiday Bungalows is entirely at the users risk and no liability can be accepted for death, injury and loss or damage to users or their belongings. No responsibility can be accepted for loss or damage to belongings or vehicles.
You are responsible for the property and are expected to take all reasonable care of it. Please leave your bungalow in the same state of repair, and in the same clean and tidy condition at the end of the rental period as at the beginning. You must not use the properties for any dangerous, offensive, noxious, noisy, or immoral activities or carry out there any act that may be a nuisance or annoyance to the owner or other neighbouring properties. Smoking is not allowed in any of the bungalows.
You are legally bound to reimburse us for replacement, repair or extra cleaning costs incurred as a result of your stay. Please report accidental damage or breakage when it happens so that repairs or replacement items can be arranged before the arrival of the next guests, and for your use before you leave. We welcome responsible pet owners and one well behaved dog to stay in the specifically allocated bungalows (3,4 & 5). The dog must be under proper supervision and control at all times, and not be left alone at any point of the stay. We reserve the right to terminate the holiday should the pet be deemed a nuisance through noise or behaviour to others. The dog is not permitted on any of the furniture, and it must be kept on a lead around the site unless inside the bungalow or in the enclosed back garden of said property. We must insist that all mess be cleared daily from the grounds of the property and placed in allocated bin, and you will be responsible for any damages caused by your dog. There is an additional charge of £25 for your stay with your four-legged friend (payable at the time of booking).
We shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.
